If, at the time of sale, legal action has been initiated against the tenant, the buyer has the option to substitute the seller in this action without the right to claim any amounts from the seller - except for lawyer and attorney fees accrued until the transfer date, which will be the buyer's responsibility.

The current occupancy status or restrictions on property visits may hinder: (i) its official appraisal as required by law, preventing it from being mortgaged while the occupancy situation remains unchanged, thus necessitating alternative guarantees for financing, and (ii) the owner from obtaining the energy efficiency certificate. If the property lacks any security deposits or guarantees established in the lease contract due to the seller not being the initial lessor, the buyer will release the seller from the obligation to provide these deposits or guarantees.

The sale price has been determined considering these circumstances, which have affected the property's value, and the buyer must explicitly accept these conditions during the transfer process. It is advisable for the buyer to seek professional legal advice before making a purchasing decision.
